Analisis Peran Advokat dalam Merancang Strategi Penyelesaian Sengketa: Studi Kasus di Kantor Hukum Josant and Friends

Abstract
This study aims to analyze the strategic role of advocates in designing and determining the direction of effective dispute resolution, using a case study of legal practice at Josant and Friends Law Office, established on February 5, 2021. As a profession responsible for upholding the law and protecting clients' rights, advocates are required not only to master normative legal aspects but also to possess tactical skills in formulating legal strategies that are responsive to the dynamics of each case. Employing a qualitative method with a case study approach—through in-depth interviews, direct observation, and case document analysis—this research finds that the role of advocates at Josant and Friends spans all stages of dispute resolution, from pre-dispute processes to mediation, negotiation, and litigation. The strategies applied are tailored to the complexity of legal issues, the client’s interests, and the characteristics of opposing parties and chosen dispute resolution forums. The success of these strategies is supported by strong team collaboration and precise legal risk mapping, highlighting that the advocate’s role must be both legalistic and pragmatically solution-oriented.
